Definitions <\/h2><p>In these terms and conditions, the following definitions apply:<\/p><ul><li><p>Loteraise: Loteraise B.V., established in the Netherlands.<\/p><\/li><li><p>Organizer: the association, foundation, company, or other party that organizes a lottery, raffle, giveaway, or similar campaign via the Loteraise platform.<\/p><\/li><li><p>Participant: a natural person who participates in a lottery or giveaway.<\/p><\/li><li><p>Platform: the software, website, and services provided by Loteraise.<\/p><\/li><li><p>Agreement: any agreement between Loteraise and the Organizer.<\/p><\/li><\/ul><h2>Article 2. Applicability <\/h2><ol><li><p>These terms and conditions apply to all offers, agreements, services, and deliveries by Loteraise.<\/p><\/li><li><p>Deviations are only valid if agreed upon in writing.<\/p><\/li><li><p>The general terms and conditions of the Organizer are explicitly excluded.<\/p><\/li><\/ol><h2>Article 3. Services of Loteraise <\/h2><ol><li><p>Loteraise provides an online platform for organizing and facilitating lotteries, raffles, giveaways, and related campaigns.<\/p><\/li><li><p>In principle, Loteraise acts solely as a technical and administrative facilitator and not as the legal organizer of a game of chance, unless otherwise agreed in writing.<\/p><\/li><li><p>Loteraise can provide support with:<\/p><ul><li><p>online ticket sales;<\/p><\/li><li><p>QR code systems;<\/p><\/li><li><p>payment processing;<\/p><\/li><li><p>draws;<\/p><\/li><li><p>game rules;<\/p><\/li><li><p>licensing processes;<\/p><\/li><li><p>communication and promotion.<\/p><\/li><\/ul><\/li><\/ol><h2>Article 4. Responsibilities of the Organizer <\/h2><ol><li><p>The Organizer remains responsible at all times for:<\/p><ul><li><p>compliance with laws and regulations;<\/p><\/li><li><p>obtaining any necessary permits;<\/p><\/li><li><p>correct communication towards participants;<\/p><\/li><li><p>the delivery of prizes;<\/p><\/li><li><p>tax obligations;<\/p><\/li><li><p>the content of campaigns and promotions.<\/p><\/li><\/ul><\/li><li><p>The Organizer guarantees that all information provided is accurate and complete.<\/p><\/li><li><p>The Organizer indemnifies Loteraise against third-party claims arising from the organized promotion.<\/p><\/li><\/ol><h2>Article 5. Use of the Platform <\/h2><ol><li><p>It is not permitted to use the platform for:<\/p><ul><li><p>illegal activities;<\/p><\/li><li><p>misleading campaigns;<\/p><\/li><li><p>fraud;<\/p><\/li><li><p>activities in violation of Dutch law.<\/p><\/li><\/ul><\/li><li><p>Loteraise may block or remove accounts or campaigns in the event of abuse or violation of these terms.<\/p><\/li><\/ol><h2>Article 6. Payments and Rates <\/h2><ol><li><p>Setup fees, subscription fees, transaction fees, or revenue-dependent fees may apply for the use of the platform.<\/p><\/li><li><p>All amounts are exclusive of VAT unless otherwise stated.<\/p><\/li><li><p>Invoices must be paid within 14 days of the invoice date.<\/p><\/li><li><p>In the event of late payment, Loteraise may:<\/p><ul><li><p>charge statutory interest;<\/p><\/li><li><p>charge collection costs;<\/p><\/li><li><p>suspend services.<\/p><\/li><\/ul><\/li><\/ol><h2>Article 7. Payouts <\/h2><ol><li><p>Payouts are processed via the payment provider chosen by the Organizer or via a payment solution offered by Loteraise.<\/p><\/li><li><p>Loteraise is not liable for delays or errors caused by payment providers or banks.<\/p><\/li><li><p>Loteraise may temporarily block payouts in case of suspected fraud, violation of legislation, or requests from regulatory authorities.<\/p><\/li><\/ol><h2>Article 8. Intellectual Property <\/h2><ol><li><p>All intellectual property rights regarding the platform, software, designs, texts, and systems remain the property of Loteraise.<\/p><\/li><li><p>Materials from Loteraise may not be copied, modified, or distributed without written permission.<\/p><\/li><\/ol><h2>Article 9. Availability of the Platform <\/h2><ol><li><p>Loteraise strives for the highest possible availability of the platform but does not guarantee uninterrupted operation.<\/p><\/li><li><p>Maintenance, malfunctions, or external factors may temporarily affect availability.<\/p><\/li><\/ol><h2>Article 10. Liability <\/h2><ol><li><p>The liability of Loteraise is limited to the amount paid out by its liability insurance in the relevant case.<\/p><\/li><li><p>If no payout occurs, liability is limited to the amount the Organizer paid to Loteraise in the preceding 3 months.<\/p><\/li><li><p>Loteraise is not liable for:<\/p><ul><li><p>indirect damage;<\/p><\/li><li><p>consequential damage;<\/p><\/li><li><p>loss of revenue;<\/p><\/li><li><p>reputational damage;<\/p><\/li><li><p>missed earnings;<\/p><\/li><li><p>damage due to malfunctions of third parties.<\/p><\/li><\/ul><\/li><li><p>Nothing in these terms excludes liability for intent or deliberate recklessness.<\/p><\/li><\/ol><h2>Article 11. Privacy and Data Processing <\/h2><ol><li><p>Loteraise processes personal data in accordance with its privacy statement.<\/p><\/li><li><p>If Loteraise processes personal data on behalf of the Organizer, an additional data processing agreement may be concluded.<\/p><\/li><\/ol><h2>Article 12. Force Majeure <\/h2><ol><li><p>Loteraise is not liable for delays or shortcomings resulting from force majeure.<\/p><\/li><li><p>Force majeure includes, among other things:<\/p><ul><li><p>malfunctions;<\/p><\/li><li><p>internet problems;<\/p><\/li><li><p>cyber attacks;<\/p><\/li><li><p>government measures;<\/p><\/li><li><p>pandemics;<\/p><\/li><li><p>strikes;<\/p><\/li><li><p>failure of payment providers or hosting services.<\/p><\/li><\/ul><\/li><\/ol><h2>Article 13. Termination <\/h2><ol><li><p>Loteraise may terminate the agreement immediately in the event of:<\/p><ul><li><p>fraud;<\/p><\/li><li><p>abuse;<\/p><\/li><li><p>violation of legislation;<\/p><\/li><li><p>non-payment.<\/p><\/li><\/ul><\/li><li><p>Upon termination, outstanding payment obligations remain in effect.<\/p><\/li><\/ol><h2>Article 14. Amendments <\/h2><p>Loteraise may amend these terms and conditions. The most current version will be published on: <br><a href=\"https:\/\/www.loteraise.com\/?utm_source=chatgpt.com\">www.loteraise.com<\/a><\/p><h2>Article 15.
